Warranty conditions of LED2WORK GmbH
In addition to your statutory warranty rights, LED2WORK grants a five-year manufacturer's warranty as well as a 15-year offer for spare parts, repair and replacement delivery.
Warranty conditions (PDF)§ 1 Subject matter and purpose of the warranty
LED2WORK GmbH (“LED2WORK”) grants its customers (“Customer”) a warranty of five (5) years from the date of delivery (the “Warranty”). This warranty exists in addition to the statutory warranty rights and does not limit them. The warranty is intended to give the beneficiary additional assurance regarding the quality and durability of the products manufactured by LED2WORK.
§ 2 Warranty event and scope of the warranty
The warranty, to the extent described below, applies exclusively to products that LED2WORK has manufactured itself and in which only original LED2WORK spare parts are installed. The warranty does not extend to parts or components that do not originate from LED2WORK and were not integrated into LED2WORK's production process (merchandise, e.g. external power supplies, connecting cables).
The warranty applies exclusively if the product exhibits one of the following defects (the “Warranty Event”):
- a) Material defects: damage or defects attributable to faulty material of the product;
- b) Design defects: faults in the construction or design of the product that impair its function;
- c) Manufacturing defects: production-related defects that arose during the manufacturing process.
Within the scope of this warranty, LED2WORK undertakes, at its discretion, to provide the following services upon occurrence of a Warranty Event:
- a) to repair the defective product (repair); or
- b) to supply an equivalent replacement product, whereby the Customer accepts deviations in lighting properties (e.g. luminous flux, light colour) and performance changes compared with the originally delivered products due to technical progress (replacement); or
- c) to grant reasonable financial compensation at LED2WORK's reasonable discretion, at most a refund of the purchase price against return of the defective product (financial compensation).
The warranty does not cover any further services, in particular not a) the costs of removal, reinstallation or transport, except as provided in § 5 No. 3, and b) compensation for consequential damage (e.g. production losses or lost profits). The warranty expires upon proper provision of a warranty service.
§ 3 Conditions for claiming under the warranty
LED2WORK grants the warranty only if all of the following conditions are met:
- The product was installed and operated in accordance with the technical specifications and operating instructions supplied by LED2WORK with the delivery.
- Installation was carried out by qualified specialists in compliance with the applicable electrotechnical requirements.
- The product was used as intended, in particular in environments that correspond to the specified operating conditions (e.g. temperature range, humidity level).
- No conversions, modifications, structural changes, reconfigurations or other alterations were made to the product.
- Maintenance and cleaning were carried out at regular intervals, professionally and in accordance with LED2WORK's specifications.
§ 4 Warranty period
The warranty applies for a period of five (5) years from the date of delivery.
§ 5 Grounds for exclusion
The warranty is excluded for defects or damage that are not attributable to a fault as defined in § 2 No. 2 of these warranty conditions (“Grounds for Exclusion”). Grounds for exclusion include, by way of example but not exhaustively:
- Improper use: use of the product for a purpose other than intended (e.g. use outside the intended field of application);
- Operation under conditions that do not correspond to the technical specifications and operating instructions (e.g. extremely high/low temperatures, excessive humidity or aggressive environments; use of cleaning agents other than those specified in the operating instructions);
- Mechanical damage: damage caused by external mechanical influences such as impacts, knocks, improper handling, damage due to improper transport or storage;
- Electrical damage: damage caused by overvoltage, short circuit or incorrect electrical installation;
- The use of non-approved accessories, spare parts or harmful cleaning agents;
- Force majeure: damage caused by natural events such as lightning, floods, earthquakes or other unforeseeable events;
- Interference by third parties: repair attempts or modifications by unauthorised persons that, for example, impair seals;
- Natural ageing processes: wear, tear and ageing. Natural wear of components such as seals, cables or other parts, as well as damage attributable to natural ageing or wear resulting from external influences, in particular chemical influences;
- A decline in luminous flux of up to 0.6 %/1000 operating hours over the service life, as well as a failure within the nominal failure rate of approx. 0.2 % per 1000 operating hours; and
- Assembly errors.
§ 6 Asserting a warranty claim
To assert a warranty claim, the following steps are required:
- The Customer is obliged to notify LED2WORK in writing of the fault without delay after its discovery.
- The Customer is obliged to submit a copy of the invoice and, where applicable, further evidence of the delivery date, the fault and any resulting defects.
- At LED2WORK's request, the product must be sent in for inspection. The Customer initially bears the shipping costs; these will be reimbursed by LED2WORK in the event of a justified warranty claim.
- After inspecting the product, LED2WORK decides whether a Warranty Event exists and which measures LED2WORK will take in accordance with § 2 No. 3 (repair, replacement or financial compensation).
§ 7 15-year offer of spare-part supply, repair and new delivery (each against a paid order)
For up to 15 years after the date of delivery, in the event of a defect in the delivered product, LED2WORK provides the following against a paid order: (i) spare parts for the delivered product, (ii) repair of a defective product, and (iii) the delivery of a new product that at least mechanically/electrically approximates the delivered product.
§ 8 Other provisions
This warranty applies exclusively to the first purchaser. Rights under this warranty are not assignable.
LED2WORK and the Customer hereby agree that products or components replaced in accordance with § 2 No. 3 become the property of LED2WORK.
§ 9 Final provisions
The place of performance for all warranty services is LED2WORK's registered office, unless otherwise stated in the warranty conditions.
If the Customer is a merchant, a legal entity under public law or a special fund under public law, the sole place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is LED2WORK's registered office. However, LED2WORK is also entitled to bring an action at the Customer's place of business.
The legal relationships in connection with these warranty conditions are governed exclusively by German substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods.
